"Unë dashuroj si gjithë të tjerër!"

15 vjet më parë, Shqipëria dekriminalizoi marrëdhëniet homoseksuale. 15 vjet më vonë, vendi ynë, ka bërë një serë përparimesh në drejtim të respektimit të të drejtave të komunitetit LGBT. Një serë organizatash mbrojnë të drejtat e komunitetit, Komisioneri për Mbrojtjen nga Diskriminimi dhe Ligji, veprojnë në mbrojtje të tyre. Sidoqoftë ka ende një rrugë të gjatë për të bërë, në mënyrë që të garantojmë gëzimin e të drejtave të barabarta për të gjithë personat LGBT në Shqipëri.

Ligji nuk iu njeh çifteve LGBT të njëjtat të drejta, që Kodi i Familjes iu njeh çifteve bashkëjetuese heteroseksuale në Shqipëri. Kjo do të thotë se, ndonëse të gjithë qytetarët janë të barabartë para ligjit dhe duhet të gëzojnë të njëjtat të drejta, përsëri ligji vazhdon të diskriminojë pa të drejtë për shkak të orientimit seksual apo edhe identitetit gjinor!

Transgjinorët jetojnë në një situatë ekstreme të transfobisë. Ajo është e patolerueshme, degraduese, johumane dhe shpesh ve në rrezik jetën e tyre.Asnjë institucion shtetëror deri më sot nuk ka marrë masa për të strehuar, ushqyer apo punësuar, një komunitet që, për shkak të identitetit gjinor, keqtrajtohet apo neglizhohet si nga shoqëria ashtu edhe nga institucionet publike. Transgjinorët nuk kanë mundësi të rregjistrohen në identitetin gjinor të zgjedhur prej tyre dhe shumë prej tyre nuk janë të rregjistruar në rregjistrin e shtetasve.

Homofobia nuk ka nevojë që të jetë e hapur apo e shprehur! Ajo në shumicën e rastevefshihet pas injorimit, harresës, mungesës së politikave, standarteve dhe veprimeve, të cilat në vend që të promovojnë respektin për diversitetin human, përkundrazi, i shtyjnë njerëzit drejt frikës, mohimit të vetëvetes apo të fëmijëve, vëllezërve e motrave, miqve e të afërmëve, vetëm sepse njerëzit kanë lindur me nje orientim të ndryshëm seksual apo identitet gjinor.

Familjet e homoseksualëve, lesbikeve, biseksualeve dhe transeksualeve, jetojnë me frikën se mostë dashurit e tyre shahen me fjalë të rënda, fyhen, pushohen nga puna, dhunohen, diskriminohen nga e gjithë shoqëria dhe shteti apo edhe me keq vriten. Kjo i bën ata që të ndjehen të diskriminuar edhe vetë, të lënë në harresë apo të parë “vrëngër” nga pjesa tjetër e shoqërisë, vetëm sepse institucionet shtetërore nuk ndërmarrin fushata kombëtare informimi dhe edukimi në mbështetje të personave LGBT dhe familjarëve të tyre.

Ligji për Mbrojtjen nga Diskriminimi është një hap i parë i madh drejt mbrojtjes së qytetarëve shqiptarë nga çdo formë diskriminimi, përfshirë edhe komunitetin LGBT. Por nga ana tjetër ka ardhur koha që ky ligj të përmirësohet në drejtim të përcaktimit të një mekanizmi kombëtar shtetëror të zbatimit të ligjit, si dhe mbi të gjitha, të ndalimit njëherë e përgjithëmonë të gjuhës së urrejtjes .

Komisioneri për Mbrojtjen nga Diskriminimi dhe Ministria e Punës, Çështjeve Sociale dhe Shanseve të Barabarta, kanë bërë një punë që duhet përshëndetur në drejtim të trajtimit serioz të rasteve të shkeljeve të të drejtave të njeriut të komunitetit LGBT. Nga ana ana tjeter ne mendojmë se ka ardhur koha që këto institucione si dhe Ministria e Brendshme, Ministria e Drejtësisë, Ministria e Mbrojtjes, Ministria e Shëndetësisë, të japin mbështetjen e tyre publike dhe institucionale në drejtim të komunitetit dhe personave LGBT.

Në Prill të këtij viti, për herë të parë në historinë e tij, komuniteti LGBT përgatiti Manifestin për të Drejtat e Personave LGBT në Shqipëri. Ky manifest fokusohet në pesë fusha kryesore: parandalimi i diskriminimit, siguria, shërbimet sociale e të përkujdesjes, strehimi dhe punësim. Ky manifest prezanton sot, fushat kryesore mbi të cilat institucionet shtetërore duhet të ndërtojnë punën e tyre drejt përmirësimit të gjendjes të të drejtave të njeriut të komunitetit LGBT.

Bashkitë dhe Komunat në të gjithë Shqipërinë luajnë një rol të jashtëzakonshëm drejt mbrojtjes dhe përkrahjes së qyterarëve me shërbime, të cilat përmirësojnë jetën e tyre. Në këtë drejtim mbetet ende shumë për të bërë në të gjithë Shqipërinë, por sidomos nga Bashkitë në Tiranë, Durrës, Shkodër, Elbasan, Fier, Vlorë, Korçë, Gjirokastër, Sarandë e Kukës, duke mbështetur me strehim, punë e shërbime sociale personat LGBT që jetojnë në këto qytete. Qeverisja vendore nuk mund të neglizhojë apo më keq tregojë shenja homofobie e transfobie ndaj qytetarëve të saj, të cilët janë të barabartë e kontribuojnë po njësoj, si gjithë qytetarët e tjerë, duke paguar taksat e detyrimet e tyre.

Nga ana tjetër ne nxisim komunitetin LGBT që të denoncojë çdo rast dhune, diskriminimi, kërcënimi apo gjuhe të urrjetjes të përdorur ndaj tyre. Komisioneri për Mbrojtjen nga Diskriminimi është një institucion tashmë i specializuar për të administruar në mënyrë konfidenciale ankesat e tyre. Besimi ndaj institucioneve rrit edhe besimin e tyre ndaj komunitetit!

Së fundmi, një falenderim të posaçëm për median. Gjatë vitit 2010 e në vijim, media ka trajtuar me vërtetësi dhe në shumicën e rasteve me objektivitet rastet e shkeljes të të drejtave të personave LGBT. Ne duam t’ju inkurajojmë që në misionin tuaj të rëndësishëm të informimit të publikut, të vijoni informimin pa paragjykim dhe duke treguar ndjeshmëri ndaj të gjithë personave LGBT dhe sidomos familjarëve të tyre. Sjellja e modeleve pozitive të jetës së komunitetit LGBT vetëm rrit e forcon respektin për të drejtat e njeriut në Shqipëri.

Ambasada Pinkështë një zyrë që punon për mbështetjen e komunitetit LGBT në Shqipëri. Ambasada Pink mbështetet nga LGBT PRO Shqipëri, një organizatë lokale shqiptare, që punon për mbrojtjen dhe avancimin e të drejtave të komunitetit LGBT në vend. "I love like everyone else!"

17 May - International Day Against Homophobia and Transphobia the world focuses on the evaluation of achievements and raising concerns about the situation of lesbian, gay, bisexual and transgender community (LGBT). On this day, PINK Embassy and LGBT PRO Albania chose a message of love, called "I love like everyone else, to focus on positive aspects of the behavior of every human being, as a way to inform people about each individual's basic rights, including equal rights for LGBT people.

15 years ago, Albania decriminalised homosexual relationships. 15 years later, our country has made a series of breakthroughs in terms of respect for the rights of LGBT. A series of organizations defending the rights of the community are established, while Commissioner for Protection from Discrimination and the Law, act in their defense. However there is still a long way to make, in order to guarantee the enjoyment of equal rights for all LGBT persons in Albania.

The law does not provide an LGBT couple with the same rights, which Family Code provides heterosexual couples living in Albania. This means that although all citizens are equal before the law and should enjoy the same rights, the law continues to discriminate unfairly because of sexual orientation or gender identity!

Transgender people live in an extreme situation of transphobia. It is intolerable, degrading, inhumane and often endangering their lives. No public institution has so far taken steps to provide, care or employment, to a community that, because of gender identity, is abuse or neglected by society as well as public institutions. Transgender people are not allowed to change their gender identity and many of them are not registered in the citizens’ registrar.

Homophobia does not need to be open or expressed! It is mostly hidden behind ignorance, forgetfulness, lack of policies, standards and actions, which shall be in place to promote respect for human diversity, rather than pushing people to fear, deny themselves or their children, brothers and sisters, friends and relatives, just because people are born with a different sexual orientation or gender identity.

Families of gay, lesbian, bisexual and transgender people, live in fear that their beloved will be blamed, insulted, fired, violated, discriminated against by the whole society and the state or even worse murdered. This makes them feel discriminated themselves, making their life difficult from the rest of society, just because state institutions do not undertake national information and education campaigns in support of LGBT people and their families.

Law on Protection from Discrimination is a great first step towards the protection of Albanian citizens from any form of discrimination, including the LGBT community. On the other hand it is time that this law be improved in terms of setting up a national mechanism to implement state law, and above all, the ban once and forever the language of hate.

Commissioner for Protection from Discrimination and the Ministry of Labour, Social Affairs and Equal Opportunities, shall be acknowledged for their work in dealing with serious cases of violations of LGBT rights. On the other hand we strongly believe that it is time that these institutions and many others such as the Ministry of Interior, Ministry of Justice, Ministry of Defence, Ministry of Health, to provide public support and institutional and community towards LGBT persons.

In April this year, for the first time in its history, LGBT community prepared the Manifesto on the LGBT Rights in Albania. The manifesto focuses on five key areas: prevention of discrimination, safety, social services and care, housing and employment. The Manifesto represents today the main areas on which institutions should build their work towards improving the situation of LGBT people.

Municipalities and communes across Albania play a tremendous role to protect and support citizens with services that improve their lives. In this regard, much remains to be done in the entire country, but especially by the municipalities of Tirana, Durres, Elbasan, Fier, Vlora, Korca, Gjirokastra, Saranda and Kukes, in supporting housing, social services and employment of LGBT people living in these cities. Local government cannot neglect or worse show signs of homophobia or transphobia against its citizens, who are equal and equally contribute, like all other citizens, in paying their taxes and other obligations.

We also encourage the LGBT community in Albania to use every opportunity to denounce violence, discrimination, intimidation or hate speech used against them. The Commissioner for Protection from Discrimination is already a specialized institution to administer their complaints confidentially. Confidence on the institutions increases also their confidence and communication with the community!

Finally, a special thanks goes to media. During 2010 and onwards, the media has reported in most cases objectively violation of the rights of LGBT persons. We would like to further encourage the media in their important mission of informing the public, without prejudice while showing sensitivity to all LGBT people and especially their families. Bringing positive models of community life it strengthens the LGBT movement and increases the respect for human rights in Albania.
