I nderuar Zoti Ministër,

Ditën e hënë, më 20 Dhjetor 2010, Asambleja e Përgjithshme e Kombeve të Bashkuara do të votojë mbi përfshirjen ose jo të mbrojtjes së personave LGBT në një Rezolutë tejet të rëndësishme mbi ekzekutimet jashtëgjyqësore dhe vrasje të tjera të paligjshme.

10 vitet e fundit kjo Rezolutë i ka nxitur shtetet “të hetojnë me kujdes të gjitha vrasjet…të gjitha vrasjet e kryera për çdo lloj arsyeje diskriminuese,përfshirë edhe orientimin seksual”. Kjo është Rezoluta e vetme e Kombeve të Bashkuara që përfshin në mënyrë eksplicite referencën për orientimin seksual.

Muajin e kaluar, një numër shtetesh propozuan amendimin e saj për të hequr referencën e orientimit seksual nga kjo rezolutë e rëndësishme. Ky amendim u miratua me një diferencë shumë të vogël votash, me 79 shtete që votuan për heqjen e referencës së orientimit seksual, 70 shtete që mbështetën mos heqjen e referencës dhe 43 shtete që abstenuan ose nuk votuan. Për fat të keq përfaqësuesi i Shqipërisë në Organizatën e Kombeve të Bashkuara nuk ishte prezent në votim.

Megjithatë egziston mundësia e rivendosjes së orientimit seksual dhe madje duke përfshirë edhe identitetin gjinor, përmes ridiskutimit të kësaj Rezolute në Asamblenë e Përgjithshme të OKB-së në 20 dhjetor 2010 në Neë York.

Ambasada PINK / LGBT Pro Shqipëri dhe Aleanca kundër Diskriminimit LGBT, dy organizata që punojnë drejtpërdrejtë në drejtim të mbrojtjes dhe respektimit të të drejtave të komunitetit LGBT në Shqipëri, i kërkojnë Shtetit shqiptar, që përmes përfaqësuesit të saj në OKB, të mbështesë përfshirjen në këtë rezolutë të mbrojtes së personave për shkak të orientimit seksual dhe identitetit gjinor nga vrasjet e paligjshme.

Ne kërkojmë që Shteti Shqiptar, nëpërmjet përfaqësuesve të saj, të mbështesë përfshirjen në këtë Rezolutë të orientimit seksual dhe identitetit gjinor jo vetëm për shkak të angazhimeve të saj të shprehura publikisht dhe ndërkombëtarisht në mbrojtje të të drejtave të këtij komuniteti, por edhe sepse vrasja e njerëzve për cfarëdo lloj arsyeje nuk mund të jetë KURRË e pranueshme.

Në Shkurt të vitit 2010, Shqipëria miratoi një nga ligjet më të avancuara në Europë, për mbrojtjen e nga diskriminimi. Ligji e shtrin mbrojtjen e tij nga diskriminimi edhe per komunitetin LGBT në Shqipëri. Një vend me një legjislacion kaq të përparuar nuk mund të votojë PRO VRASJES së qytetareve të thjeshtë në një vend tjetër, pasi njerëzit kanë të njëjtin dinjitet dhe të drejta kudo ku ata jetojnë.

Ne jemi të gatshëm të takohemi dhe të diskutojmë më tej me ju për këtë cështje kaq të rëndësishme që në fakt ka të bëjë me një prej formave më serioze të dhunimit të të drejtave të njeriut, të të drejtës së jetës.

ALBANIA must vote pro the inclusion of LGBT community at the resolution on the extrajudicial killings, to take place on 20th December during the UN General Assembly's

Dear Mr. Minister,

On Monday, 20 December 2010, the General Assembly of the United Nations will vote on the inclusion or not of protecting LGBT people in a very important resolution on extrajudicial executions and other unlawful killings.

This resolution has so far encouraged for 10 years, all the states to "carefully investigate all the murders ... all killings committed for any discriminatory reason, including sexual orientation." This is the only resolution of the United Nations that explicitly refers to sexual orientation, as a ground of such executions or unlawful killings.

Some countries, members of UN proposed during last month to remove the reference to sexual orientation from this important resolution. This amendment was adopted by a small margin of votes: 79 states voted for the removal of sexual reference, 70 countries did not supported the removal of reference, while 43 countries abstained, or did not voted at all!

Unfortunately, the Albanian representative at the United Nations was not present during the voting process.

However, there is still another possibility to restore what was done wrong and to include sexual orientation and gender identity as part of this resolution, because the UN General Assembly will vote again on it, on 20th December 2010 in New York.

PINK Embassy / LGBT Pro Albania and The Alliance Against Discrimination of LGBT people, - two mainstream organizations that protect and promote the respect of LGBT rights in Albania, fully supported by other human rights organizations which signed this common request, - demand from the representative of Albania at the UN, to be present on the next voting process, first of all, and to fully support the inclusion in this resolution the protection of persons in risk of being killed because of their sexual orientation or gender identity.

We request from the Albanian state, through its representatives to UN, to support the inclusion in this resolution of sexual orientation and gender identity, as grounds of unlawful killings, not only because it is part of Albania’s commitments expressed publicly and internationally to protect the rights of the LGBT community, but also because the killing of people for whatever reason can not be acceptable!

Albania adopted in February 2010 one of the most advanced Anti-Discrimination laws in Europe that extends its protection from discrimination also to the LGBT community in the country. A country with such advanced legislation can not vote PRO murder of ordinary citizens in other countries on grounds of their sexual orinetation or identity, because all the people have the same dignity and rights wherever they live.

We are ready to meet and discuss further more with you on this issue, that is so important to all of us.
